Christopher Turner Couture & The 200 Club

By accessing our website at christopherturnercouture.com, submitting a membership inquiry, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Christopher Turner Couture and The 200 Club, each a private, non-incorporated entity (collectively, the "Company," "we," "us," or "our").


If you do not agree to these Terms, you must discontinue use of our website and services immediately.

3.1 Age and Capacity Requirements
You must be at least 18 years of age and have the legal capacity to enter into contracts under South Carolina law to use our services or apply for membership.


3.2 Membership Application Process
●    Membership in The 200 Club is by invitation or private inquiry only
●    All applicants must complete our Private Inquiry for Membership form truthfully and completely
●    False or misleading information may result in immediate disqualification
●    The Company reserves the right to accept, decline, or terminate membership applications or existing memberships at its sole discretion


3.3 Membership Tiers and Requirements
●    Founding Members: Limited to 20 lifetime positions, personally invited by Christopher Turner
●    Legacy Members: Limited to 80 annual positions, requiring commission of three or more garments annually
●    Circle Members: Limited to 100 annual positions, requiring commission of two garments annually

4.1 Service Description
We provide bespoke menswear design and tailoring services, including but not limited to custom suits, formal wear, and casual pieces through our mobile atelier service.


4.2 Pricing and Payment
●    All pricing is provided individually through private consultation
●    Payment terms will be specified in separate service agreements
●    All sales are final unless otherwise specified in writing
●    South Carolina sales tax applies where required by law


4.3 Service Delivery
●    Delivery timelines are estimates and may vary based on design complexity
●    We will make reasonable efforts to meet agreed-upon delivery dates
●    Delays due to circumstances beyond our control do not constitute breach of contract

5.1 Permitted Use
Our website is intended for legitimate business inquiries and member communications. You may view and download content for personal, non-commercial use only.


5.2 Prohibited Activities
You may not:
●    Use our website for any unlawful purpose
●    Reproduce, distribute, or publicly display our proprietary content without written permission
●    Attempt to gain unauthorized access to our systems
●    Transmit viruses, malware, or other harmful code
●    Impersonate another person or entity

6.1 Company Property
All website content, designs, sketches, patterns, methodologies, and materials are the exclusive intellectual property of Christopher Turner Couture and are protected by copyright, trademark, and trade secret laws.


6.2 Customer Rights
Upon full payment for commissioned garments, customers receive ownership of the physical garment while the Company retains all design rights and intellectual property.


6.3 Legacy Archive Rights
By engaging our services, you consent to the discretionary inclusion of your garments and associated stories in our Legacy Archive for historical and marketing purposes, subject to our Privacy Policy.

7.1 Information Collection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.


7.2 Member Confidentiality
Members agree to maintain confidentiality regarding other members, club activities, and proprietary information shared during membership.

8.1 Service Warranty
We warrant that our services will be performed with professional skill and care consistent with industry standards. Our sole obligation for any warranty breach is to re-perform defective services at no additional cost.


8.2 Disclaimer of Other Warranties
EXCEPT AS EXPRESSLY STATED HEREIN, ALL SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH CAROLINA LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.


9.2 Excluded Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE THEORY OF LIABILITY.


9.3 South Carolina Law Compliance
Nothing in these Terms shall limit liability that cannot be excluded under South Carolina law, including liability for death or personal injury caused by negligence or fraud.

You agree to indemnify, defend, and hold harmless Christopher Turner Couture and The 200 Club, each a private, non-incorporated entity, and their principals, employees, contractors, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or violation of applicable law.

11.1 Order Cancellation
Custom orders may be cancelled within 72 hours of order confirmation. After commencement of work, cancellation may result in charges for work completed.


11.2 Refund Policy
Refunds, if applicable, will be processed according to the specific terms outlined in individual service agreements and in compliance with South Carolina consumer protection laws.

12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles.


12.2 Jurisdiction and Venue
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in South Carolina, and you consent to the jurisdiction of such courts.


12.3 Limitation Period
Any claim or cause of action arising under these Terms must be filed within one (1) year after the claim or cause of action arose, or it shall be forever barred.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government actions, or natural disasters.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and the Company regarding the use of our services and supersede all prior agreements and understandings.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date.

 

Continued use of our services after posting constitutes acceptance of the modified Terms.
